1. Status of an enquiry
An enquiry is an initial discussion only. It does not guarantee acceptance, availability, pricing or a delivery date. A commission begins only after NDev Studios issues a written proposal, the client accepts it in writing and the required initial payment is received.
3. Scope and specification
The accepted proposal defines the scope, deliverables, expected schedule, payment structure, included revisions and support. Work outside that scope is not automatically included.
4. Client responsibilities
The client must provide accurate requirements, suitable access, lawful materials and timely decisions. Credentials should be shared only when necessary and replaced after handover where appropriate.
5. Revisions and scope changes
Up to two grouped revision rounds are included for changes within the agreed scope. Bug fixes do not consume revision rounds. Additional rounds, new features and substantial redesigns may require a separate quotation.
6. Communication and approval
Written decisions in the official project Discord channel may be treated as approval of scope, revisions, testing outcomes and delivery. The client should review information carefully before confirming.
7. Testing, approval and delivery
NDev Studios tests the commission internally before client review. After final approval and cleared final payment, the agreed product is delivered or deployed with the files and documentation listed in the proposal.
8. Ownership and reusable knowledge
The client receives the agreed completed product after final payment. NDev Studios may continue using general skills, techniques and independently reusable components, but will not reuse customer branding, credentials, private information or customer-specific work without permission.
9. Retention, confidentiality and portfolio use
A backup ZIP may be retained through the support period and for seven additional days. Continued retention for future work requires client permission. Public portfolio use requires explicit agreement by both parties, and confidentiality may be requested without an additional charge.
10. Inactivity
When a required client response is not received for 14 days, development may be paused. After 30 days, NDev Studios may close the commission following written notice. Restarting may depend on current availability and a revised schedule.
11. Fairness and statutory rights
Nothing in these draft terms is intended to remove rights or remedies that cannot lawfully be excluded. Commission-specific terms and required pre-contract information will be provided in a format the client can save before payment.
